§ 5-24. Fee imposed; collection generally; payment required.

(a)

There is hereby levied a fee of five dollars ($5.00) per day per motor vehicle or a yearly seasonal fee of thirty dollars ($30.00) per motor vehicle for the use of all beach access ramps for ingress to the city beach within the corporate limits of the city.

(b)

There is hereby levied a fee of five dollars ($5.00) per day per motor vehicle or a yearly seasonal fee of thirty dollars ($30.00) per motor vehicle for driving or parking a motor vehicle on the city beach when entry to the beach is by other than access ramps within the city.

(c)

It shall be unlawful for any person to own or to drive a motor vehicle on the city beach or beach access ramps within the city without first paying the fees provided by this section to the county. The city authorizes all fees to be collected by the county.

(d)

Failure to possess a receipt for the required daily fee, or yearly seasonal fee, when a motor vehicle is on the city beach during the days and times for enforcement of this article, shall be deemed a violation of this section.

(e)

The yearly seasonal fee shall be twenty dollars ($20.00) if paid prior to March 1 of each year, provided that such fee is also authorized by the county.

(f)

The current receipt for the required daily fee shall be affixed to the inner front windshield of all motor vehicles in such a manner as to be conspicuously visible to a passerby during all times in which the owners or drivers of such motor vehicles are required to have paid said daily fee and to possess a receipt or ticket for said daily fee.

(g)

The current receipt for the yearly seasonal fee shall be permanently affixed to the inner front windshield of all motor vehicles in such a manner as to be conspicuously visible to a passerby during all times in which the owners or drivers of such motor vehicles are required to have paid said fee and to possess a receipt or ticket for said yearly seasonal fee.

(h)

In the event the motor vehicle has no front windshield, the current receipt for the required daily fee or yearly seasonal fee shall be affixed to the vehicle in such a place as to be conspicuously visible to a passerby during all times in which the owner or driver of such motor vehicle is required to have paid said fee and to possess a receipt for said fee. The current receipt for the yearly seasonal fee shall be permanently affixed to such place.

(i)

As used in this section the words "permanently affixed" shall mean the affixing of the receipt by removing the protective covering from the adhesive material and placing the receipt on the windshield, or in a conspicuous place if the vehicle does not have a windshield.

(j)

A receipt shall not be affixed in a location that will unduly obstruct the vision of the operator of the vehicle.
